Terms & Conditions

1. Scope

These General Terms govern the commercial relationship between Kute Designs CUSTOM S.L. (hereinafter "Kute Designs") and the user/customer (hereinafter "the Customer") who places orders through the online store at kutedesigns.es.

3. Products and personalisation

Kute Designs offers clothing (t-shirts, sweatshirts, hoodies, etc.) with a personalisation service. Product images are for illustrative purposes only. Colours may vary slightly from what is shown on the Customer's screen.

Custom designs are the Customer's responsibility. Kute Designs reserves the right to reject designs that infringe intellectual property rights or contain illegal, offensive, defamatory or hate-inciting content.

4. Purchase process

1. The Customer selects products and, optionally, personalises them.
2. The Customer adds items to the cart and proceeds to checkout.
3. The Customer enters shipping details and selects a payment method.
4. The Customer reviews the order summary including total price (VAT included) and shipping costs.
5. The Customer confirms the order by clicking "Pay", constituting acceptance of these Terms.
6. Kute Designs sends an order confirmation email.

The purchase contract is completed upon payment confirmation (LSSI-CE art. 28).

5. Prices and taxes

All prices shown include the applicable VAT (21% standard rate in Spain) unless otherwise stated. Shipping costs are shown before order confirmation. Kute Designs reserves the right to change prices at any time without affecting orders already confirmed.

6. Payment methods

Kute Designs accepts: credit/debit card (Visa, Mastercard) via Stripe, and PayPal. Payment data is processed directly by the relevant payment gateway. Kute Designs does not store card data.

7. Shipping and delivery

• Spain (mainland & Balearics): 2–4 business days. Free shipping over €50. Standard: €4.99.
• Canary Islands, Ceuta & Melilla: 5–7 days. Customs duties (IGIC) may apply.
• European Union: 3–7 business days.

Delivery times are estimates and non-binding. For personalised products, add 1–2 business days for production. Risk of loss transfers to the Customer upon handover to the carrier (TRLGDCU art. 66ter).

8. Right of withdrawal

Under TRLGDCU art. 102, the Customer has 14 calendar days from receipt to withdraw from the contract without justification.

Exception: Under TRLGDCU art. 103.c, withdrawal is not available for products personalised to the consumer's specifications. This exception applies only where the product has actually been personalised with the Customer's own design.

9. Legal guarantee

All products carry a 3-year legal guarantee of conformity under TRLGDCU art. 120 (amended by Royal Decree-Law 7/2021 transposing EU Directive 2019/771). During the first 2 years, any lack of conformity is presumed to have existed at delivery.

10. Intellectual property

The Customer retains rights over original designs uploaded to the platform. Kute Designs obtains a limited, non-exclusive licence to reproduce the design solely to produce and deliver the order.

11. Dispute resolution

The Customer may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr

These terms are governed by Spanish law. For disputes that cannot be resolved out of court, the courts of the consumer's domicile shall have jurisdiction (Spanish Civil Procedure Act art. 52.2).
